It’s one of the questions we get most before customers place an order: is it legal to buy cannabis seeds in Spain? The short answer is that selling and possessing seeds is legal, but it’s worth understanding why, and where the line is that shouldn’t be crossed.
The Seed and the Plant Are Not the Same Under the Law
A cannabis seed on its own contains no THC or any active compound. Legally, it is treated as what it is: genetic or collector’s material, just like other agricultural or ornamental seeds. That’s why seed banks can operate normally, issue invoices and sell to any adult: what is regulated differently is what is done with that seed afterwards.
What Spanish Law Says About Cultivation and Consumption
In Spain, consuming cannabis in a strictly private setting is not criminally prosecuted, but consuming or growing it somewhere visible from a public space can lead to administrative penalties under the Citizen Security Law (Ley de Seguridad Ciudadana). Growing it for sale or distribution to third parties is an entirely different matter and falls under criminal law.
In other words, the law draws a fairly clear line between private, personal use and any activity involving commercializing the plant or its flower. Enforcement and local ordinances can also vary from one autonomous region or municipality to another.

At Trikoma Seeds we have been developing our own genetics since 2005, and our seeds are sold exclusively for collecting and preserving varieties. We do not encourage germination or any use not covered by the regulations of your place of residence: the decision about what to do with a seed, and under what legal framework, is always the buyer’s responsibility.
Regulations Vary From One Country to Another
Outside Spain, the legal treatment of cannabis seeds varies widely: some countries fully permit their sale and possession, others only allow sale as a collector’s item without the buyer germinating them, and others prohibit anything cannabis-related regardless of THC content. If you are ordering from outside Spain, it is your responsibility to check your country’s laws before placing an order.
